These Terms of Service ("Terms") govern your use of the TreeReportPro website and services ("Service") operated by TreeReportPro ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website or signing up for our waitlist or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Service.

2. Description of Service

TreeReportPro is a voice-powered tree risk assessment report generation tool designed for professional arborists. The Service allows users to dictate assessment findings, which are processed by AI to generate ISA-formatted PDF reports. The Service includes voice-to-text transcription, AI-powered report formatting, photo management, and PDF generation and delivery.

3. Waitlist

By joining our waitlist, you understand that:

  • Waitlist position does not guarantee early access to the Service
  • Launch timing is subject to change without notice
  • We will use your provided contact information to send updates about the Service
  • You may remove yourself from the waitlist at any time by contacting us

4. User Accounts and Responsibilities

When the Service launches, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Use the Service only for lawful purposes related to arboriculture and tree risk assessment
  • Not share your account with unauthorized users

5. Professional Disclaimer

TreeReportPro is a tool to assist qualified arborists in generating reports. It is not a substitute for professional judgment, training, or certification.

  • AI-generated content should always be reviewed by a qualified arborist before submission
  • Risk ratings and recommendations generated by AI are suggestions based on input data and should be verified
  • The user (licensed arborist) remains solely responsible for the accuracy and completeness of all reports
  • TreeReportPro does not provide arboricultural advice and is not responsible for decisions made based on generated reports

6. Intellectual Property

The TreeReportPro name, logo, website design, and software are our intellectual property. You may not copy, modify, or distribute any part of our Service without written permission.

Reports generated through our Service are your property. You retain all rights to your assessment data, photos, and generated reports. We do not claim ownership over your content.

7. Subscription and Payments

When the paid Service launches:

  • Subscription fees are billed monthly or annually as selected
  • Payment is processed securely through Stripe
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • Refunds may be issued at our discretion for the current billing period
  • We reserve the right to change pricing with 30 days' notice to existing subscribers

8. Limitation of Liability

To the maximum extent permitted by law:

  • TreeReportPro is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not responsible for losses arising from AI-generated content that was not reviewed by a qualified professional

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. The offline capability of our PWA helps mitigate connectivity issues.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms, use the Service for unauthorized purposes, or fail to pay subscription fees. Upon termination, you may request export of your data within 90 days.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved in the courts of New York County, New York.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
